Agency Description The Law Department's civil practice includes unique issues involving public interest. Our lawyers help chart the course for the City in business, health, safety, commerce, civil rights, taxation, and community development. The Water Division of the Regulatory Law Unit represents the City and the Water Department in matters relating to the City's water, stormwater and wastewater systems. Attorneys are, with appropriate training and supervision, expected to manage a diverse set of transactional matters; defend the City in administrative appeals and hearings before the Tax Review Board and Board of Licenses and Inspection Review involving disputed water bills and notices of defects; support the Water Department in utility rate hearings before the Philadelphia Water, Sewer and Storm Water Rate Board; provide advice and counseling on matters involving compliance with federal and state laws, regulations and permits; represent the City in actions to enforce Water Department regulations; and assist the Water Department with the drafting of new regulations and policies. Attorneys in the Water Division also represent the Streets Department and the Mayor's Office of Sustainability on certain matters as needed. Job Description The Regulatory Law Unit's Water Division is currently seeking a licensed Pennsylvania attorney to fill a Senior Attorney position. The attorney will work directly with the Water Department's senior management team on a variety of key initiatives including: drafting and negotiating complex agreements; providing legal advice on environmental compliance matters and Water Department Regulation enforcement matters; providing support on a large case load of administrative appeals before the Tax Review Board and Board of License and Inspection Review; supporting the Water Department on utility rate proceedings; and supporting efforts to continue and expand public outreach between rate cases to key stakeholder groups representing a diverse set of customers. The attorney will work independently with minimum supervision by the divisional deputy. Essential Functions In addition to the Position Summary, responsibilities include but are not limited to:
    • Advising and representing the City of Philadelphia and the Water Departments in various transactional matters.
    • Reviewing, drafting and negotiating professional service agreements, grant agreements, easement agreements, and cost sharing and project cooperation and assistance agreements with state and federal agencies.
    • Negotiating various National Pollutant Discharge Elimination System (NPDES) permits and consent orders and handling compliance matters under State and Federal environmental laws with Pennsylvania Department of Environmental Protection and US Environmental Protection Agency.
    • Supporting the Water Department before and during rate proceedings before the Philadelphia Water, Sewer and Stormwater Rate Board, including preparation of testimony and pre-filing documents, assistance in responding to discovery requests, and advice and counseling on Pennsylvania law and industry standards regarding ratemaking and ratemaking principles.--
    • Managing administrative and civil actions to enforce Water Department regulations against property owners, developers, plumbers and non-compliant customers and for violations arising under the Philadelphia Code.
    • Negotiating settlements of disputed water bills, delinquent accounts and violation notices.
    • Reviewing and evaluating federal and state laws that affect the Water Department's operations and functions.
    • Researching and analyzing issues and drafting documents relating to the environmental laws, public utility law, enforcement of regulations, municipal claims and liens, the Philadelphia Code and the Philadelphia Charter.
    • Assisting with training and mentoring of new attorneys.
    • Representing other City Departments on transactional matters as requested. Qualifications Education and Experience The candidate should have a minimum of 10 years of legal experience in environmental law and/or utility rate cases.--Legal experience should include contracts, environmental law, municipal business processes, and utility matters.-- Candidates must be a member of the Pennsylvania Bar. Competencies, Knowledge, Skills and Abilities
      • Knowledge of laws, legal codes, court procedures, precedents, government regulations, executive orders, agency rules and process
      • Ability to analyze large amounts of information, determine relevant facts, and propose viable solutions
      • Ability to find what laws and regulations apply to a specific matter
      • Ability to communicate information and ideas verbally and in writing--
      • Ability to work directly with other City Departments
      • Ability to understand and use the Water Department's computerized maintenance management and billing tracking systems
      • Strong drafting, negotiating and management skills
